General Information

We, the company App Toro s.r.o. (ID No.: 06454097; with its represented seat at Viktora Huga 377/4, Smichov, 150 00 Prague 5, Czech Republic; the company incorporated under the laws of Czech Republic and registered by the Municipal Court in Prague under No. C 282461, hereinafter referred as “App Toro”), respect your privacy and your data protection rights. Under recent legislation concerning data privacy (General Data Protection Regulation), many types of data have been requalified as Personal Data to catch up with the nature of the digital age. Thus, the legal language used in Terms of Use & Privacy Policy has got stricter and may create an impression that companies are collecting unnecessarily big amounts of Personal Data despite that they are collecting the same data as before but this data is now qualified as personal. Therefore, we need your clearly expressed Consent that we may process this data. The personal data means any information related to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic mental, economic, cultural or social identity of that natural person (hereinafter as “Personal Data”).

• If you are using the App without making purchases, you are an anonymous user to us and we collect only technical information necessary for running and improving the app (iOS version, device model, app usage, crash reports, device time zone) – some of this data has been requalified as Personal Data as well.
• When you are purchasing services, we need to identify your Apple ID
• We don´t share any information concerning you or your device with any 3rd parties unless it is necessary for running the App, delivering services, our own internal marketing activities or fulfilling legal obligations.
  • Technical 3rd parties are f.e. Apple (app), Amazon Web Services (servers), Graylog (logs), etc..
• We don´t have access to files on your device

Consent

By downloading and installing the application service Texter (hereinafter as “App”) I hereby understand that App Toro may collect, use and process my Personal Data including contact information (email), device information (unique device identifier, IP address, device language), location (device’s location - region, time zone), etc. for providing and using the App and related services provided by App Toro. This personal data is necessary in the context of a contract.

I hereby also give a consent to the App Toro to process my above-mentioned Personal Data for developing the App and related services provided by App Toro and for sending commercial or informative communication relating to App Toro’s services. I may withdraw this consent via data.protection.officer@apptoro.agency.

​I hereby declare that in case I no longer wish that my Personal Data to be processed, I can arrange for ending of processing by uninstalling the App whereby I have explicitly been made aware of the fact that uninstalling the App is the only way to stop processing the Personal Data entirely.

When you install or download our App, we may collect variety of non-personal data of technical nature (version of the operating system, device model, device language, numbers, dates and times of the communications, name of the country, from which the sending party sends a message and name of the country to which the message goes, time zone, etc.). This data allows us e.g. to provide application services, improve the App’s performance and resolve potential technical issues. We may collect also other kinds of data that are considered as Personal Data e.g.: contact information (if you reach our support – e-mail address and other information supplied to us in accordance with our support service), device information (unique device identifier). These are used based on your consent for targeting of internal marketing campaigns – sending commercial or informative communication relating to our services (never third-party marketing campaigns) and delivery of services purchased via the App.​

How do we use your Personal Data?

We collect the Personal Data to provide the App and application services to you. Furthermore, we collect the Personal Data to maintain and develop the App and related services; for our internal commercial or informative communication; for our own marketing campaigns (we never transfer your data to third parties for any marketing purposes).

How do we process your Personal Data? 

The Personal Data are processed both in an automated and a manual way and are stored for as long as is necessary to provide Customer with the App (for the duration of your use of the App) and for a reasonable period of time after the last use of the App, not exceeding five years.

We provide and share information We collect to trusted partners (f.e. Apple Inc., Twilio Inc or Amazon Web Services that are essential for running and providing our service) to process it for Us based on our instruction and in accordance with our Terms of Use. We use only Processors that provide sufficient guarantees to implement appropriate technical and organizational measures in such a manner that processing will meet the requirements of the Customer’s protection right. Personal Data are shared with above specified third parties in an anonymized form. Provider does not share Personal Data with third parties for marketing purposes.

Your rights

You shall have the right to obtain from Us confirmation as to whether or not the Personal Data concerning You are being processed, and, where that is the case, to access to the Personal Data and the following information: the purposes of the processing, the categories of the Personal Data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed; the envisaged period for which the Personal Data will be stored, the existence of the right to request from the controller rectification or erasure of the Personal Data, the data sources, the existence of automated decision-making.
